Statement by Lawyers for Democratic Reform in Swaziland (LAW-DERSWA) on the Resolution Passed by the 118th U.S Congress Condemning Human Rights Violations in Eswatini.

As the Lawyers for Democratic Reform (LAW-DERSWA), we welcome and acknowledge the resolution
passed by the 118th US Congress condemning the human rights record of the Government of the
Kingdom of Eswatini and the brutal killing of Eswatini activist Thulani Maseko on January 21, 2023. This
resolution represents a critical stance by the United States in defence of human rights and democratic
principles.

We commend the Senate’s condemnation of the murder of Thulani Maseko and its concern about the
cycle of political violence and instability in Eswatini. This resolution’s emphasis on the necessity for the
Government of Eswatini to conduct a thorough and impartial investigation into Maseko’s assassination
is essential for accountability and justice. Furthermore, the call for the protection of human rights
activists and the cessation of surveillance and intimidation highlights the importance of safeguarding
freedom of speech and assembly.

The resolution’s demand for an inclusive national dialogue on constitutional and political reform aligns
with LAW-DERSWA’s mission to promote democratic and legal reforms. We support the resolution’s
call for the full staffing and independence of the Commission of Human Rights and Public Accountability
(CHRPA), ensuring proper oversight and accountability.

Additionally, we appreciate the encouragement for the United Nations High Commissioner for Human
Rights to conduct an independent investigation into Mr. Maseko’s assassination and human rights
violations in Eswatini. This international involvement can bring transparency and objectivity to the
investigation process.

LAW-DERSWA also supports the resolution’s urging of the US Secretary of State and the Administrator
of the United States Agency for International Development to expand support for journalists, human
rights advocates, and media freedoms in Eswatini. Strengthening these areas is essential for nurturing
a vibrant democratic society.

Finally, the encouragement of targeted sanctions against individuals and entities committing human
rights violations in Eswatini serves as a strong deterrent against such actions and underscores the
commitment to upholding international human rights standards.

LAW-DERSWA stands in solidarity with the US Congress and international community in their efforts to
promote democratic and legal reforms in Eswatini and to hold accountable those responsible for human
rights violations. We urge the Government of Eswatini to heed the calls of the resolution and take
immediate steps to address these pressing concerns for the betterment of its people and society.
