Statement by LAW-DERSWA on the Dismissal Case Victory of Mbongwa Dlamini, President of the Swaziland National Association of Teachers (SNAT) The SNAT Platform

The Lawyers for Democratic Reform in Swaziland (LAW-DERSWA) commend the High Court of Eswatini for upholding justice in the dismissal case of Mbongwa Dlamini, President of the Swaziland National Association of Teachers (SNAT). On Friday, 15 November 2024, Judge Zonke Magagula dismissed the review application filed by the Teaching Service Commission (TSC), reinforcing the Industrial Court ruling by Judge Menene Tfwala, which declared Mr. Dlamini’s dismissal unlawful due to the lack of a disciplinary hearing.
This decision underscores the fundamental principles of justice, procedural fairness and the rule of law. The dismissal of Mr. Dlamini without due process was a blatant violation of his constitutional and labour rights, setting a troubling precedent for labour relations in Eswatini. LAW-DERSWA applauds the judiciary for affirming that no individual or institution is above the law and that public officials must act within the bounds of fairness and legality.
The victory of Mr. Dlamini is not only a personal triumph but also a beacon of hope for all workers in Eswatini. It serves as a reminder that unjust actions by employers, including government entities, will be held to account. This judgment strengthens the resolve of labour unions and civil society to advocate for workers’ rights and stand against any form of injustice and persecution.
